Agreement between User and FireTEXT®
The FireTEXT® website ("Site") and services are operated by FireTEXT® ("Company," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of FireTEXT®'s website, mobile applications, messaging services (including SMS notifications), and related services (collectively, the "Services").

2.3 User Responsibilities

• You acknowledge that SMS is not a replacement for traditional emergency communication systems.

FireTEXT® may contain links to external websites ("Linked Sites"). FireTEXT® is not responsible for the content or privacy practices of Linked Sites and does not endorse any third-party services.

4. No Unlawful or Prohibited Use

You agree not to use FireTEXT® for any unlawful, harmful, or prohibited activities, including but not limited to:

• Spamming, phishing, or sending unsolicited commercial messages.
• Interfering with the operation of the FireTEXT® Services.
• Attempting unauthorized access to our systems.

5. Use of Communication Services

FireTEXT® provides in-app chat, messaging tools, and bulletin boards ("Communication Services"). You agree to:

• Use Communication Services only for appropriate purposes.
• Not post or share harmful, illegal, or offensive content.

FireTEXT® reserves the right to monitor, remove, or restrict access to Communication Services as needed.

6. Materials Provided to FireTEXT®

FireTEXT® does not claim ownership of materials you submit (e.g., feedback, comments). However, by submitting content, you grant FireTEXT® permission to use, distribute, and modify such content for service improvements.

7. Liability Disclaimer

FireTEXT® provides services "AS IS" without warranties of any kind. FireTEXT® is not responsible for:

• Service interruptions, data loss, or inaccuracies.
• Any indirect, incidental, or consequential damages.
• Failures in message delivery due to third-party networks (e.g., wireless carriers).

Some states do not allow the exclusion of certain warranties, so these limitations may not apply to you.

8. Termination of Access

FireTEXT® reserves the right to suspend or terminate user accounts without notice if:

• There is suspected misuse of FireTEXT® Services.
• User violates these Terms.
• Required by law enforcement or regulatory authorities.

9. Governing Law & Jurisdiction

These Terms shall be governed by the laws of Arkansas, U.S.A.. You consent to exclusive jurisdiction in Craighead County, Arkansas for any disputes.

• System Notifications: Account changes, service updates, and system alerts.

2. Message Frequency & Associated Fees

• Message Frequency: Varies based on department activity and user settings.
• Standard Messaging & Data Rates May Apply: FireTEXT® does not charge for SMS notifications, but your carrier's standard messaging rates may apply.

3. How to Opt-Out of SMS Messages

You can stop receiving SMS messages at any time:

• Reply STOP to any FireTEXT® message to opt out.
• You will receive a final confirmation message stating that you have unsubscribed.
• Once opted out, you will no longer receive any text messages unless you re-subscribe.
